Terms of Service

1. The service
Gradika is a school platform for CBC assessment, computer-based testing, exams and report cards, attendance, fee records, duty rosters, and parent communication. Each school runs in its own branded space on its own subdomain. By registering a school or signing in, you agree to these terms.
2. Accounts and roles
- School admins register the school, invite staff, and manage its data. The school warrants that it is authorised to enter learner and guardian information.
- Teachers access only the classes and subjects the school assigns them.
- Parents/guardians sign in with the phone number their school registered and a personal PIN. Keep your PIN private; anyone holding it can see your child's records.
- Learners sign in with school-issued usernames and PINs for practice and tests.
3. The school's responsibilities
As data controller, the school is responsible for the lawfulness and accuracy of the data it enters: enrolling the right learners, linking the right guardians, obtaining any consents or giving any notices its own policies and the Data Protection Act, 2019 require, and promptly removing access for staff who leave. Gradika processes this data on the school's behalf as described in our Privacy Policy.
4. Acceptable use
Don't attempt to access another school's or another user's data, probe or disrupt the service, or use it for anything unlawful. We may suspend accounts that put other users' data at risk.
5. Fees and billing
School subscriptions are billed as agreed with the school (M-Pesa supported). School-fee records kept in Gradika are the school's own records; Gradika does not hold or move school fees. Where parents pay the school, money flows directly to the school's own accounts.
6. Availability and data
We work to keep the service available and your data safe, but the service is provided "as is" and connectivity, maintenance windows, or events beyond our control may interrupt it. Schools may request an export of their data at any time; on termination we delete the school's data after a reasonable wind-down period, except where law requires retention.
7. Liability
To the maximum extent the law allows, Gradika's aggregate liability arising from the service is limited to the subscription fees the school paid in the twelve months before the claim. Nothing in these terms limits liability that cannot lawfully be limited.
8. Changes, termination, and law
We may update these terms as the service evolves; material changes will be dated above and communicated to school admins. Schools may stop using the service at any time. These terms are governed by the laws of Kenya, and disputes are subject to the jurisdiction of Kenyan courts.
